I heard it said that he could only be cleared if he was charged, tried, and then found not guilty of the crime, but because there is not enough evidence to charge him, he can not be considered cleared. Seems like a ridiculous semantic argument to me, but by this standard, no one could ever be considered innocent when accused unless they were subsequently charged and tried.
