OT: Legal question for the gurus

Asking for a friend.

He signed a non-compete with a company. On the Contract, the company is listed as an LLC when in fact it was an Inc. Also, the agreement was for a 1099 employee when they were later changed to a w-2 worker(no new agreement was signed.

In Tennessee does that non-compete have any legs?
