Since it's the weekend and I can't get in contact with any lawyers I thought the GQ might be able to assist for anyone in the know as the legal forums haven't been very helpful. I had 2 kids with my ex (we were never married) and have been apart for 4 years. She has them most of the time but we've never had the need for a formal custody agreement as it's always been somewhat coordial. Short of the story is I have our 5 and 6 yr old for spring break and they told me very specifically about how here new boyfriend is hitting and slapping them. I was going to take them back to Santa Cruz tomorrow but given this development there's no way in hell I'm going to until a child protective case is open and investigated. My kids don't make this stuff up but I can't open a case until they open on Monday or file for custody or anything that will protect them until court opens. In the meantime she's threatened to call the cops and have me picked up for kidnapping tomorrow. Again there's no custody agreement, I'm in possession of the kids, but typically they are primarily with her. Any advice regarding my rights or what to do would be much appreciated. I'm in California for those not familiar with Santa Cruz.
